Hektiska dagar

One journalist’s story: from triumph to torture

In an article for the Guardian, John Pilger describes presenting a top journalism award to a young Palestinian, Mohammed Omer, and how, on his return home to Gaza, he was seized by the Israelis, who demanded the prize money and tortured him.

Two weeks ago, I presented a young Palestinian, Mohammed Omer, with the 2008 Martha Gellhorn Prize for Journalism. Awarded in memory of the great American war correspondent, the prize goes to journalists who expose establishment propaganda, or “official drivel”, as Martha called it. Mohammed shares the prize of £5,000 with the fine war reporter Dahr Jamail. At 24, Mohammed is the youngest ever winner. His citation reads: “Every day, he reports from a war zone, where he is also a prisoner. His homeland, Gaza, is surrounded, starved, attacked, forgotten. He is a profoundly humane witness to one of the great injustices of our time. He is the voice of the voiceless.” The eldest of eight children, Mohammed has seen most of his siblings killed or wounded or maimed. An Israeli bulldozer crushed his home while the family were inside, seriously injuring his mother. And yet, says a former Dutch ambassador, Jan Wijenberg, “he is a moderating voice, urging Palestinian youth not to court hatred but seek peace with Israel.”

Getting Mohammed to London to receive his prize was a major diplomatic operation. Israel has perfidious control over Gaza’s borders, and only with a Dutch embassy escort was he allowed out. Last Thursday, on his return journey, he was met at the Allenby Bridge crossing from Jordan by a Dutch official, who waited outside the Israeli building, unaware that Mohammed had been seized by Shin Bet, Israel’s infamous security organisation. Mohammed was told to turn off his cell phone and remove the battery. He asked if he could call his Dutch embassy escort and was told forcefully he could not. A man referred to as Avi stood over his luggage, picking through his documents. “Where’s the money?” he demanded. Mohammed produced some US dollars.

“Where’s is the English pound you have?”

“I realised,” said Mohammed, “he was after the award stipend for the Martha Gellhorn Prize. I told him I didn’t have it with me. ‘You are lying’, he said. I was now surrounded by eight Shin Bet officers, all armed. The man called Avi ordered me to take off my clothes. I had already been through an x-ray machine. I stripped down to my underwear and was told to take off everything. When I refused, Avi put his hand on his gun. I began to cry: ‘Why are you treating me this way? I am human being’. He said, ‘This is nothing compared with what you will see now’. He took his gun out, pressing it to my head and with his full body weight pinning me on my side, he forcibly removed my underwear. He then made me do a concocted sort of dance. Another man, who was laughing, said, ‘Why are you bringing perfumes?’ I replied, ‘They are gifts for the people I love’. He said, ‘Oh, do you have love in your culture?’

“As they ridiculed me, they took delight most in mocking letters I had received from readers in England.  I had now been without food and water and the toilet for twelve hours, and having been made to stand, my legs buckled. I vomited and passed out. All I remember is one of them gouging, scraping and clawing with his nails at the tender flesh beneath my eyes. He scooped my head and dug his fingers in near the auditory nerves between my head and eardrum. The pain became sharper as he dug in two fingers at a time. Another man had his combat boot on my neck, pressing into the hard floor. I lay there for over an hour. The room became a menagerie of pain, sound and terror.”

An ambulance was called and told to take Mohammed to a hospital, but only after he had signed a statement indemnifying the Israelis from his suffering in their custody. The Palestinian medic refused, courageously, and said he would contact the Dutch embassy escort. Alarmed, the Israelis let the ambulance go. The Israeli line, as reported by Reuters, is familiar; it is that Mohammed was “suspected” of smuggling and “lost his balance” during a “fair” interrogation.

Israeli human rights groups have documented the routine torture of Palestinians by Shin Bet agents with “beatings, painful binding, back bending, body stretching and prolonged sleep deprivation”. Amnesty has long reported the widespread use of torture by Israel, whose victims emerge as mere shadows of their former selves. Some never return. Israel is high in an international league table for its intimidation and murder of journalists, especially Palestinian journalists who receive barely a fraction of the kind of coverage given to the hostage-taking of the BBC’s Alan Johnston.

The Dutch government says it is shocked by Mohammed Omer’s treatment. Former ambassador Jan Wijenberg said, “This is by no means an isolated incident, but part of a long term strategy to demolish Palestinian social, economic and cultural life… I am aware of the possibility that Mohammed Omer might be murdered by Israeli snipers or bomb attack in the near future.”

While Mohammed was receiving his prize in London, the new Israeli ambassador to Britain, Ron Proser, was publicly complaining that many Britons no longer appreciated the uniqueness of Israel’s democracy. Perhaps they do now.

First lawsuit against Israeli soldiers in Spain

Antonio Segura, Gonzalo Boye, Raul Maillo, Juan Moreno, Lawyer have a long experience in cases concerning International Law and Humanitarian Law. These lawyers are very known in Spain because of their fight for human rights in Universal Jurisdiction. The most known case was the one of Pinochet, who was held in Great Britain for more than one year. Also they represented victims of torture in Guatemala; the case of Jose Couso, the Spanish camera that was killed by American soldiers in Bagdad, and many others like Scilingo case or the bombing in Madrid 11M. Their commitment with the victims around the world make them being very known by human rights and solidarity groups.

Jointly with Palestinian Centre for Human Righs, in behalf of it his Director Raji Sourani, this lawsuit is the first in Spain and several Human rights Associations have been working together with the group of Lawyers for more than two years now. After a long wait, the 24th of June was presented in the Audiencia Nacional (National Courts) and we wait to see that justice and moral compensation come to the victims, while the perpetrators of such a crime are held to the justice. The Spanish civil society (with groups like Arab Cause Solidarity Committee and Al-Quds Asociation for Solidarity with People in Arab Countries and many others)  jointly with other groups around the world are working to make justice in Palestine, while, at the same time, the governments leave aside their obligations and act in an immoral and non political way just trying to compensate economically the Palestinians, without any considerations of their political and international commitments. We are happy to say that Spain join the group of countries, whose tribunal had accepted cases against Israeli militars, as Great Britain, Switzerland, Netherland, United States or New Zealand. And we hope justice to be make with the victims.

First lawsuit against Israeli soldiers in Spain. Six survivors together with relatives of the victims caused by a bomb launched by the Israeli Army on July 22, 2002 against Gaza, will bring a lawsuit in the Audiencia Nacional (National Court). Although this is not the first time people have asked this Court to deal with crimes against humanity, it is the first time that the victims of an Israeli targeted attack in the Palestinian territories have asked the Court by themselves.

The lawsuit, 35 pages long, explains in detail why these events should be considered war crimes subject to universal jurisdiction: the attack was disproportionate.

One target: fifteen casualties.

Around midnight, an Israeli war plane launched a one ton bomb over the Gaza neighbourhood of Al Daraj. The target was Salah Shehadeh, a suspect HAMAS commander. The bomb destroyed his house and seven more at the same time. Thirty more people were also affected, fifteen died and one hundred and fifty sustained injuries of various degrees.

The lawsuit is against the Israeli Defence Minister, Benjamin Be-Eliezer, and six people under his orders. The victims were told by an Israeli court that the attack was proportionate. However, the international community considered it illegal and disproportionate, especially taking into account the sophisticated Israeli military technology.

Summary

Israeli violations of international law and humanitarian law continued in the OPT during the reporting period (19 – 25 June 2008):

Shooting: During the reporting period, IOF killed 3 Palestinians in the West Bank and the Gaza Strip, and wounded 18 others, including 5 children and 2 old men.

In the West Bank, IOF killed 2 Palestinians and wounded 13 others, including 5 children.

On 24 June 2008, IOF extra-judicially executed 2 Palestinians in Nablus; a prominent activist of the al-Quds Brigades (the armed wing of Islamic Jihad) and a university student. This attack came after the Egypt-brokered truce between Palestinian resistance groups in the Gaza Strip and Israel entered into force on 19 June 2008, which indicates that IOF may escalate attacks against Palestinians in the West Bank.

On the same day, 12 Palestinian civilians, including 4 children, were wounded when IOF used force to disperse a peaceful demonstration organized in protest to the construction of the Annexation Wall in Ne’lin village, west of Ramallah. A Palestinian child was also wounded in similar circumstance in Far’oun village, south of Tulkarm.

In the Gaza Strip, on 19 June, IOF killed an activist of the Palestinian resistance and wounded 3 others in Gaza Valley village, nearly 500 meters away from the border between the Gaza Strip and Israel. An IOF aircraft fired a missile at those activists just one hour before the truce entered into force.

On 23 June, IOF troops positioned at the border between the Gaza Strip and Israel to the northwest of Beit Lahia town in the northern Gaza Strip fired at a number of Palestinian children who attempted to get close to the border. A number of Palestinian farmers were working on their lands nearly 400 meters away from the border.

On 24 June, an elderly Palestinian civilian was wounded by the IOF gunfire in similar circumstance in Khuza’a village, east of Khan Yunis.

Incursions: During the reporting period, IOF conducted at least 36 military incursions into Palestinian communities in the West Bank, the widest of which was into Qalqilya. During these incursions, IOF arrested 48 Palestinian civilians, including 14 children. To date, 1,382 Palestinian civilians have been arrested by IOF in the West Bank since the beginning of 2008.  IOF also demolished 2 uninhabited houses and partially demolished 3 houses, in Qalqilya.

Restrictions on Movement: IOF have continued to impose a tightened siege on the OPT and imposed severe restrictions on the movement of Palestinian civilians in the Gaza Strip and the West Bank, including occupied East Jerusalem.

Gaza Strip

IOF have continued to close all border crossings to the Gaza Strip for more than two years. The IOF siege of Gaza, which has tightened since June 2007, has had a disastrous impact on the humanitarian situation in the Gaza Strip, and has violated the human, economic and social rights of the approximately 1.5 million Palestinian civilian population, particularly their rights to appropriate living conditions, health and education. The siege has also paralyzed the Gazan economy. In addition, the siege has severely impacted the flow of food, medical supplies and other necessities such as fuel, construction materials and raw materials for various economic sectors. IOF have continued to prevent the entry of raw materials into the Gaza Strip, and many factories have been forced to close. Severe restrictions have been imposed on the movement of the entire Palestinian civilian population. Regarding civilian movements, IOF permit very few Palestinian civilians to pass through Beit Hanoun (Erez) crossing in order to travel to the West Bank or Israel. Rafah International Crossing Point in the southern Gaza Strip is the sole outlet for the Gaza Strip to the outside world via a country other than Israel. IOF have closed Rafah International Crossing Point, even though they do not directly control it. They have prevented European observers working at the crossing point from reaching it.

Even though the Egypt-brokered truce between Palestinian resistance groups and Israel entered into force, no major change has been noticed with regard to the movement of persons and goods through the Gaza Strip border crossings, excluding an approximate 20% increase in the amounts of foods and humanitarian aids allowed into the Gaza Strip during the reporting period.

The closure of border crossings deprives the Palestinian civilian population in the Gaza Strip of their right to freedom of movement, education and health. IOF have continued to impose severe restrictions on fishing in the Gaza Strip. Fishermen have been subjected to intensive monitoring and harassment by IOF, which use helicopter gunships and gunboats severely restrict their access to coastal waters.

West Bank

Contrary to Israeli claims of easing restrictions on the movement of Palestinian civilians, IOF have continued to impose severe restrictions on the movement of Palestinian civilians throughout the West Bank. Thousands of Palestinian civilians from the West Bank and the Gaza Strip have been denied access to Jerusalem. IOF have established many checkpoints around and inside the city. Restrictions of the movement of Palestinian civilians often escalate on Fridays to prevent them from praying at the al-Aqsa Mosque. IOF sometimes assault Palestinian civilians who attempt to bypass checkpoints and enter the city. IOF have also tightened the siege imposed on Palestinian communities in the West Bank. IOF positioned at various checkpoints in the West Bank have continued to impose severe restrictions on the movement of Palestinian civilians and have continued to erect checkpoints on the main roads and intersections in the West Bank.

Settlement Activities: IOF have continued settlement activities and Israeli settlers living in the OPT have, in violation of international humanitarian law, continued to attack Palestinian civilians and property. On 19 June, Israeli settlers burnt large areas of Palestinian agricultural land in Bourin village, south of Nablus. On the same day, an Israeli settler ran down an elderly Palestinian civilian near Qalqilya. He was seriously injured. On 20 June, Israeli settlers attacked a number of Palestinian farmers and shepherds in Yatta village, south of Hebron. Two shepherds were injured. On 24 June, Israeli settlers attacked 3 Palestinian shepherds in Yatta village south of Hebron and injured them.
